Grace Bay, Turks & Caicos – The team at ParrisWhittaker is proud to announce a recent victory for Partner, George C. Missick. Earlier this spring, Missick represented local businessman/landowner, Gilbert Selver, in his battle against the Turks and Caicos Islands Government.
A high court judge ruled in favour of Selver, stating that the government is “not entitled to possession” of his properties in the Kew Town area of Providenciales.
“This is obviously a major victory for Mr. Selver. But this is also a victory for all of the hard-working commercial landowners in our community. This is a statement that the government cannot unilaterally decide that the ownership of your land is suddenly invalid,” said Missick.
Selver lawfully built apartments around crown land near the Providenciales International Airport. However, years later, he was told by the TGIC that his claim to said land was invalid because he did not have the requisite leases. He was also told that he would have to tear down his buildings.
“All Mr. Selver wanted to do was run his apartment buildings, which now also includes the Sunset Ridge Hotel, and earn his living. However, he was bullied and treated like a squatter. Fortunately, justice prevailed in the end, and we’re thrilled with this outcome,” said Missick.
Selver was also subject to unreasonable and unlawful price hikes as even though Cabinet’s last offer to Selver to purchase the freehold title on the parcels was $73,500.00 and $30,800.00 respectively, when he attempted to pay these sums, he was told that he would have to pay the current market value equivalent to over 1 million dollars. These hikes constituted a breach of contract.
“Our firm will always be here to fight on behalf of individuals that are being bullied or intimidated by the local government,” said Missick.
“We hope that people see this win as a sign that says, yes, you can fight and win against unfair treatment from the government. You don’t need to go into this fight alone. And you don’t need a big law firm to take a big stand. We can help!”
